We offer a 14-day cooling-off period in line with the Consumer Contracts Regulations. If you change your mind within that time, we will refund the amount you have paid, less a £35 administration fee to cover the banking and processing costs of issuing the refund.

However, if we have already prepared your divorce application within the 14-day cooling-off period, no refund will be payable.

Yes. Your spouse cannot stop the divorce simply because they do not want it.

Since the introduction of no-fault divorce, a divorce can only be challenged on very limited grounds, such as jurisdiction. In practice, this means that if England or Wales is the correct place for the divorce to be dealt with, your spouse cannot prevent it from going ahead just by refusing to agree.

That said, a spouse can still make the process more difficult by ignoring the paperwork or failing to respond, which can cause delays. For that reason, it is always better to let them know in advance if possible.

There is no automatic formula for dividing assets on divorce in England and Wales. The court looks at all the circumstances of the case, including each person’s income, earning capacity, property, financial needs, obligations and responsibilities, with the welfare of any children under 18 being the first consideration. In many cases, especially after a longer marriage, the starting point is often equality, but the outcome depends on what is fair in the circumstances. If you reach an agreement, it should be recorded in a consent order to make it legally binding.
