All no-fault divorces in England and Wales are subject to a court fee of £612. You may be able to get help with this fee if you are on a low income or receive certain benefits, depending on your savings. What is your refund policy?

We provide a 14-day cooling-off period in line with the Consumer Contracts Regulations. If you change your mind within that period, we will refund the amount you have paid, less a £35 administration fee to cover the banking and processing costs of issuing the refund.

However, if we have already prepared your no-fault divorce application within the 14-day cooling-off period, no refund will be payable.

Can I get a No-Fault Divorce if my spouse disagrees?

Yes. Your spouse cannot stop the divorce simply because they do not want it.

Since the introduction of no-fault divorce, a divorce can only be challenged on very limited grounds, such as jurisdiction. In practice, this means that if England or Wales is the correct place for the divorce to be dealt with, your spouse cannot prevent it from going ahead just by refusing to agree. That said, a spouse can still make the process more difficult by ignoring the paperwork or failing to respond, which can cause delays. For that reason, it is always better to let them know in advance if possible.

 

How are assets divided in a no-fault divorce in the UK?

There is no automatic formula for dividing assets on divorce in England and Wales. Can I get a no-fault divorce if I was married abroad?
